So my girlfriend moved here from the Philippines when she was about 8 years old. she was legal for about a year. her parents never helped her to change her immigration status although they are legal green card holders. Her brother was born here so he is legal too, so she is the only one who isn’t legal in her family. She is now 18 and can’t get any i.d., or drivers license, BUT he has a social security number. But when she was about 15 or 16, she got a misdemeanor and got charged with petty theft because she was with a friend who shoplifted. Everyone told her that her record would be sealed when she turned 18. Is it possible for her to still get citizenship? Maybe through marriage or amnesty? What can she do? And what can I do to help her?
As her boyfriend, there isn’t much you can do. Her criminal record might harm her chances of receiving legal status or a visa. It depends on what the sentence imposed may have been.
She needs someone to petition for her. Her parents can petition for her. Her brother cannot petition for her until he’s 21.
She cannot obtain citizenship until she has been a permanent resident for five years. If one of her parents petitions for her, she might receive permanent resident status in about 12 years. That is the current waiting period for natives of the Philippines in her classification.
