When will ‘Probation’ that is completed be changed to the disposition on my brothers criminal background?

Hi! My brother was given a citation for Theft under $500 in October 2006. He went to court, in March 2007, plead guilty and received probation before judgement since it was his first offense. He had to complete 1 year of unsupervised probation and 40 hours of community service which he did and his probation ended March 2008. When we go to Maryland Judiciary Case Search, his record still says he’s on probation. When he goes to apply for jobs, employees do not hire him and tell him it is because he is on probation per his background investigation. Should it say Probation or be changed to show that the case is closed? This is really affecting job searches and he understands his wrong doing. What should he do or is this record of case status always going to say Probation? Help!

The problem is not that he is still on probation. The problem is that his probation results in a criminal record. A record will NEVER change to show he successfully completed probation. If he did not complete it, a further breach or failure to comply would show on his record.

Your brother should be honest. He should be answering yes to be convicted of a criminal offence on employment applications. He then may have an employer who will listen to the circumstances. It may be not that the employer is put off by the conviction, but that he was untruthful about having one.

MAKE NO MISTAKE….a probation is a sentance…it does not mean you have not been convicted. The only “sentance” that doesn’t result in a criminal record is an abolute or conditional discharge.
